1. The Services

GAMME.AI lets users create, generate, remix, test, publish, share, and in some plans download digital games using AI and web-based tools. A user who creates games may be called a creator, Gammer Dev, Vibe Gammer, or similar community term. A creator's public profile area may be called a Studio.

The Services may include game generation, code generation, asset upload, template selection, AI-assisted editing, preview builds, public game pages, creator profiles, analytics, sharing cards, support tools, subscription features, and integrations with third-party infrastructure or app stores.

We may add, modify, suspend, restrict, or discontinue any part of the Services at any time. We may also apply technical limits, moderation, rate limits, file limits, download limits, or publishing restrictions.

2. Eligibility and minors

You must be at least 13 years old to use the Services. If you are under 18, you may use the Services only with approval and oversight from your parent or legal guardian, and your parent or legal guardian is responsible for your use.

The Services are not intended for children under 13, and we do not knowingly collect personal information from children under 13. If we learn that an account belongs to a child under 13, we may delete the account and associated personal data as required by law.

Certain features, contests, commercial programs, publishing programs, payments, or app-store-related workflows may require you to be older or to satisfy additional eligibility requirements.

3. Accounts and security

You may need an account to create, save, publish, download, or manage games. You must provide accurate information and keep it updated. You are responsible for safeguarding your credentials and for all activity under your account.

You may not sell, rent, transfer, share, or sublicense your account. We may suspend or terminate accounts that violate these Terms, create legal risk, cause security risk, abuse the Services, or interfere with other users.

4. User-generated games, prompts, and assets

"User Content" means any prompt, idea, instruction, uploaded asset, image, sprite, sound, model, code, title, description, game, game build, profile content, comment, report, or other material that you submit, generate, publish, share, download, or otherwise make available through the Services.

You retain whatever rights you lawfully own in your User Content. However, by using the Services, you grant GAMME.AI a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, adapt, display, perform, distribute, publish, moderate, analyze, and use your User Content as needed to provide, secure, improve, promote, and operate the Services, enforce these Terms, comply with law, and support sharing or discovery features.

You represent and warrant that you have all rights needed for any content you upload or use. This includes images, characters, music, brands, logos, sprites, 3D models, code, datasets, and any assets that may resemble or be owned by third parties.

4.5. Digital Millennium Copyright Act (DMCA) Policy

We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, we will respond expeditiously to claims of copyright infringement committed using the Services that are reported to us at dmca@gamme.ai.

If you are a copyright owner, are authorized to act on behalf of one, or are authorized to act under any exclusive right under copyright, you may report alleged infringement taking place on or through the Services by sending a DMCA Notice of Alleged Infringement containing the following:

• Identification of the copyrighted work you claim has been infringed, or a representative list if multiple works are covered.
• Identification of the material you claim is infringing or the subject of infringing activity, and information reasonably sufficient to permit us to locate it, such as a URL, game page, creator profile, asset, or other relevant location.
• Your mailing address, telephone number, and email address.
• A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law, such as fair use.
• A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act on behalf of the owner of the copyright or exclusive right allegedly infringed.
• Your full legal name and your physical or electronic signature.

Upon receipt of a valid notice, we may remove or disable access to the challenged material, notify the affected user where appropriate, and take any other action we deem appropriate, including terminating repeat infringers.

Deliver this Notice, with all items completed, to dmca@gamme.ai.

Please note that under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be liable for damages, costs, and attorneys' fees.

5. Intellectual property and third-party assets

The GAMME.AI platform, software, interfaces, branding, systems, templates, models, documentation, and underlying technology are owned by GAMME.AI or its licensors. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

You are solely responsible for your use of third-party intellectual property. If you upload, reference, or generate assets inspired by or copied from famous games, characters, brands, franchises, artists, companies, music, movies, sports teams, celebrities, or other protected works, you are responsible for ensuring you have the necessary rights or that your use is legally permitted.

GAMME.AI does not authorize infringement. We may remove, block, de-list, disable, or restrict games, assets, profiles, or downloads if we believe they violate rights, laws, these Terms, app store rules, or platform policies, or if a rights holder submits a valid request.

6. AI outputs and human review

The Services use emerging AI systems to generate or assist with games, code, copy, images, mechanics, controls, and other output. AI output may be incorrect, incomplete, duplicative, unsafe, offensive, biased, infringing, non-functional, or unsuitable for your intended use.

The Services are for entertainment, prototyping, education, and creative assistance. They are not a substitute for professional legal, copyright, security, compliance, accessibility, store submission, child safety, or engineering review. You are responsible for reviewing, testing, debugging, securing, and validating your games before publishing, distributing, monetizing, or submitting them anywhere.

7. Publishing, distribution, and creator responsibility

When you publish or share a game through GAMME.AI, you remain responsible for that game and for any claims, disputes, damages, takedowns, or obligations arising from your game, including its content, mechanics, assets, code, monetization, advertising, privacy behavior, and use outside GAMME.AI.

GAMME.AI may host or display games created by users, but we do not endorse every user-created game and are not responsible for user-generated games or for how a creator uses a generated game after download, export, submission to an app store, posting on another platform, or distribution to players.

You must comply with applicable laws, platform rules, app store rules, advertising rules, ratings requirements, consumer protection rules, privacy laws, and intellectual property laws wherever you publish, distribute, or monetize your game.

8. Plans, downloads, and code license

Certain features may require a paid plan, subscription, or credits. Downloading game code, exporting builds, commercial-use features, increased limits, advanced templates, or other premium functionality may be limited to users with eligible active plans.

Subject to your compliance with these Terms and payment of any applicable fees, GAMME.AI grants you a limited license to use code generated for your game through the Services during the period and scope allowed by your plan. If your plan expires, is canceled, refunded, charged back, or terminated, your right to download new code or access premium export features may end, and additional restrictions may apply.

This license does not give you ownership of GAMME.AI's platform, systems, base templates, proprietary libraries, brand, AI models, or third-party materials. Your right to use generated code also depends on your lawful rights to any prompts, assets, references, and third-party content used in the game.

9. Payments, subscriptions, refunds, and app stores

Paid features, subscriptions, credits, and plan terms are shown at checkout or in your account. You agree to pay applicable fees and taxes. Subscriptions may renew automatically until canceled according to the applicable checkout or account process.

If purchases are made through the Apple App Store, Google Play Store, or another app store or platform, that store's payment, billing, refund, and subscription terms apply. Apple, Google, and other stores are not responsible for user-created games, user assets, AI-generated output, or creator conduct on GAMME.AI.

To the extent the Services are distributed through Apple, Google, or another store, these Terms are between you and GAMME.AI, not the store provider. The store provider has no obligation to provide maintenance or support for the Services, and is not responsible for claims related to user-generated games or content except where required by its own terms or applicable law.

10. Acceptable use

You may not use the Services to create, upload, publish, share, or distribute content that is unlawful, harmful, abusive, exploitative, hateful, harassing, defamatory, invasive of privacy, infringing, deceptive, malicious, spammy, or otherwise objectionable.

You may not attempt to bypass security, moderation, payment, usage limits, download restrictions, or access controls; scrape or automate access without permission; interfere with the Services; upload malware; impersonate others; or use the Services to create a competing platform or to reverse engineer our systems.

We may use automated and human review to detect violations, and may remove content, restrict games, disable downloads, suspend accounts, or report illegal conduct where appropriate.

11. Third-party services and links

The Services may use or link to third-party services, including hosting providers, AI providers, payment processors, analytics tools, app stores, asset providers, community platforms, or external websites. We are not responsible for third-party terms, content, policies, availability, or practices.

12. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or error-free operation.

We do not guarantee that any game will work perfectly, be accepted by an app store, comply with third-party rules, be original, be non-infringing, generate revenue, attract players, or be suitable for commercial release.

13. Limitation of liability

To the maximum extent permitted by law, GAMME.AI will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, business interruption, reputational harm, store rejection, takedown, copyright dispute, or damages arising from user-generated games, AI output, third-party assets, or your distribution of games.

Some jurisdictions do not allow certain limitations, so some limitations may not apply to you. In those cases, our liability is limited to the fullest extent permitted by law.

14. Indemnity

You agree to defend, indemnify, and hold harmless GAMME.AI and its affiliates, officers, employees, contractors, and agents from claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from your User Content, your games, your use of third-party assets, your publication or distribution of games, your violation of these Terms, or your violation of law or third-party rights.

15. Changes, termination, and contact

We may update these Terms from time to time by posting a revised version and updating the "Last updated" date. Your continued use of the Services after changes take effect means you accept the updated Terms.

You may stop using the Services at any time. We may suspend or terminate access as described in these Terms. Sections that by their nature should survive termination will survive.
