This Privacy Notice explains how GAMME.AI ("GAMME.AI", "we", "us", or "our") collects, uses, discloses, and protects personal data when you use our websites, apps, AI game creation tools, Studio profiles, hosted games, sharing features, downloads, support tools, and related services (collectively, the "Services").

By using the Services, you acknowledge this Privacy Notice and our Cookies Policy. If you do not agree, please do not use the Services.

1. Scope and roles

GAMME.AI provides an AI-powered platform for creating, editing, publishing, sharing, and playing digital games. Creators may be called Gammer Devs, Vibe Gammers, or Studio owners. Players may access games created by users through public links, creator profiles, or game pages.

For personal data processed in connection with the Services, GAMME.AI is generally the controller. If a creator exports a game, publishes it elsewhere, adds third-party tools, or collects data outside GAMME.AI, that creator may be separately responsible for privacy compliance for that external use.

2. Information we collect

Depending on how you use the Services, we may collect:

  • Account and profile information: name, username, email, authentication identifiers, avatar, Studio handle, profile fields, preferences, and subscription status.
  • Creator content and game data: prompts, instructions, generated games, code, titles, descriptions, thumbnails, uploaded assets, images, sprites, sounds, 3D files, templates selected, version history, public game pages, and moderation reports.
  • Player and usage activity: game plays, likes, shares, views, unique-player counters, creator analytics, timestamps, interactions with public game pages, and similar activity data.
  • Technical and device data: IP address, browser and device characteristics, operating system, language, referring URLs, approximate location from IP, session identifiers, cookies, logs, crash reports, and security signals.
  • Payments and plan data: plan selection, subscription status, credits, transaction identifiers, billing metadata, and information processed by payment providers or app stores. We generally do not store full payment card numbers.
  • Communications: support tickets, bug reports, DMCA notices, feedback, emails, and other messages you send us.

3. Information from AI and generation workflows

When you use AI features, we may process your prompts, uploaded assets, selected templates, generation logs, repair attempts, moderation signals, output files, and related metadata to create and improve game builds, provide previews, debug failures, prevent abuse, and support creator workflows.

Do not submit sensitive personal information, confidential business information, credentials, government identifiers, financial account details, private health information, or content you do not have rights to use.

4. How we use information

We process information to:

  • Provide, operate, personalize, and improve the Services.
  • Create, save, preview, publish, share, and manage games and Studio profiles.
  • Operate subscriptions, downloads, credits, payments, and account features.
  • Maintain safety, security, fraud prevention, moderation, abuse detection, and policy enforcement.
  • Debug errors, analyze product performance, generate analytics, and improve AI generation quality.
  • Respond to support requests, bug reports, legal requests, copyright notices, and user inquiries.
  • Send administrative messages, service notices, product updates, and permitted marketing communications.
  • Comply with legal obligations and defend legal claims.

5. Legal bases

Where laws such as the GDPR apply, we rely on legal bases including performance of a contract, legitimate interests, consent where required, compliance with legal obligations, and protection of rights and safety.

6. Cookies and similar technologies

We use cookies and similar technologies to keep you signed in, remember preferences, secure the Services, analyze usage, improve product performance, and support marketing where permitted. You can manage cookies through browser settings and, where available, through our cookie tools. Disabling cookies may affect functionality.

7. Sharing and disclosures

We may share information with:

  • Infrastructure, hosting, storage, content delivery, analytics, logging, security, and customer support providers.
  • AI, moderation, image, code, and generation service providers that help deliver the Services.
  • Payment processors, app stores, fraud-prevention providers, and subscription management vendors.
  • Professional advisers, auditors, insurers, and legal representatives.
  • Authorities, rights holders, or other parties when required by law, to respond to DMCA or legal requests, to protect safety, or to enforce rights.
  • A successor or buyer in connection with a merger, financing, acquisition, reorganization, or sale of assets.

Public games, Studio profiles, creator names, thumbnails, game descriptions, stats, and other published content may be visible to other users and people who receive shared links.

8. User-generated content and public visibility

If you publish a game or update your Studio profile, the related content may be publicly available and indexed, embedded, previewed in social apps, or shared by others. If you unpublish a game, remove content, or delete your account, cached copies, previews, backups, or copies shared outside GAMME.AI may persist for a period of time.

Creators are responsible for the privacy behavior of exported games, third-party analytics, ads, SDKs, app-store submissions, or external distribution they add outside the GAMME.AI hosted environment.

9. App stores and third-party platforms

If you use GAMME.AI through the Apple App Store, Google Play Store, or another platform, that platform may collect and process information under its own privacy policy and terms. App stores may process purchase, refund, device, crash, analytics, and subscription information. We do not control those providers' privacy practices.

If you export or submit a generated game to an app store or other platform, you are responsible for any privacy notice, permissions, age rating, consent, SDK disclosure, and data collection required by that platform or by applicable law.

10. Children and minors

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we collected personal information from a child under 13, we will take reasonable steps to delete it.

Users ages 13-17 may use the Services only with permission and oversight from a parent or legal guardian. Parents or guardians may contact us to request review, correction, or deletion of a minor's information where required by law.

11. Security

We use technical and organizational measures designed to protect information. No online service is perfectly secure, and we cannot guarantee absolute security. You are responsible for keeping your password and account access secure.

12. Retention

We retain information for as long as needed to provide the Services, maintain accounts, preserve games and Studio profiles, operate subscriptions, comply with legal obligations, resolve disputes, prevent abuse, enforce agreements, and maintain backups. Retention periods may vary depending on the type of information and legal requirements.

13. International transfers

We may process information in countries other than where you live. Where required, we use appropriate safeguards for international transfers, such as contractual protections or other lawful mechanisms.

14. Your privacy rights

Depending on your location, you may have rights to access, correct, delete, restrict, object to processing, port your data, withdraw consent, or appeal certain decisions. Some rights may be limited by law, security needs, fraud prevention, legal obligations, or the rights of others.

U.S. state privacy laws may provide additional rights, such as rights to know/access, delete, correct, opt out of certain targeted advertising or sharing, and limit use of sensitive personal information where applicable. We do not sell personal information in the traditional sense.

15. Automated processing and AI

The Services use automated systems, including AI generation, safety checks, moderation tools, and recommendation or ranking systems. AI output is not always human-reviewed before it is shown to you. You should review AI output before relying on it, publishing it, downloading it, submitting it to stores, or distributing it to others.

16. Changes and contact

We may update this Privacy Notice from time to time and will revise the "Last updated" date. If changes are material, we may provide additional notice where required.
